Terms of Service
The agreement between you and Binatec Agency for using KlasPoint, for tutorial centres, lecturers, staff and students.
Last updated
These terms are an agreement between you and Binatec Agency, the operator of KlasPoint. By creating an account or using KlasPoint, you agree to them. If you use KlasPoint on behalf of a business, you confirm you are authorised to accept these terms for it.
1. The service
KlasPoint lets tutorial centres, lecturers and tutors ("centres") run their teaching business online: a branded website and student portal, classes, lessons and materials, attendance, assignments, quizzes, mock exams, announcements, an AI assistant, and fee collection. Students use KlasPoint to join classes, pay fees and learn. We may improve, change or retire features over time; if we remove something central to how you use the service, we will give reasonable notice.
2. Accounts
- Give accurate information and keep it up to date.
- Keep your password private. You are responsible for activity on your account; tell us straight away if you think it has been misused.
- One person per account. Centres may limit each student account to one device, and accounts that are shared may be flagged to the centre.
- If you are under 18, you need the permission of a parent or guardian to use KlasPoint.
3. If you run a centre
- You are responsible for your classes, your teaching, the content you upload, the fees you set and the promises you make to students.
- You control your students' records in KlasPoint and must have a lawful basis to collect and use them, including any parental consent the law requires. Our Data Processing Agreement applies to how we handle that data for you.
- You set your own refund rules and must make them clear to students before they pay.
- You are responsible for who you invite as staff and the role you give them.
- New lecturer accounts are reviewed before their public pages go live, and we may decline or remove an account that does not meet these terms.
4. Fees and payments
- There is no setup fee and no monthly bill for centres. KlasPoint earns a platform fee on each successful student payment: 5% on the Starter plan and 8% on the Pro plan, unless we agree otherwise in writing.
- A centre can choose whether it absorbs the fee or adds it to the price students pay. The checkout shows the student the amount they will be charged.
- Free lecturer accounts pay no platform fee and are supported by advertising.
- Student payments are processed by Flutterwave and settled directly to the centre's verified bank account, less the platform fee. KlasPoint does not hold centres' or students' money. Settlement timing and any charges by the payment provider follow the provider's own terms.
- We may change our fees with at least 30 days' notice. Changes do not apply to payments already made.
- Taxes on a centre's own income are the centre's responsibility.
5. Your content
You keep ownership of the content you upload. You give us a non-exclusive, worldwide licence to host, store, copy, process and display it only as needed to run the service for you — for example showing materials to your students, or indexing them so the study assistant can answer questions from them. You confirm you have the rights to everything you upload. We may remove content that breaks these terms or the law.
6. AI features
AI features such as the study assistant, the business copilot and question generation can be wrong. Check AI-generated questions, answers and summaries before relying on them, especially for exams, grades or money. AI output is not professional, financial or legal advice.
7. Acceptable use
You must follow our Acceptable Use Policy. In short: no illegal, harmful or infringing content, no leaked live examination questions, no attacks on the platform, no spam, and no accessing data you are not entitled to.
8. Suspension and closing accounts
You can stop using KlasPoint at any time, and ask us to close your account. We may suspend or close an account that breaks these terms, puts other users or the platform at risk, or is required to be closed by law. Where reasonable, we will tell you why and give you a chance to fix the problem first. If a centre's account closes, the centre should export any records it needs; payments already made stay subject to the centre's refund policy.
9. Availability
We work hard to keep KlasPoint running and secure, but we provide it "as is" and cannot promise it will always be available or free of errors. Planned maintenance and outages at our providers can interrupt the service.
10. Liability
- Nothing in these terms limits liability that cannot be limited under Nigerian law.
- We are not liable for indirect or consequential losses, such as lost profits, lost data or lost opportunities, or for disputes between centres and their students.
- Our total liability to you for any claim relating to KlasPoint is limited to the platform fees you paid us in the 12 months before the claim, or ₦50,000, whichever is greater.
- If you run a centre, you agree to cover our reasonable costs from claims caused by your content, your teaching or your breach of these terms.
11. Changes to these terms
We may update these terms. If a change is significant, we will tell account holders at least 14 days before it takes effect. Continuing to use KlasPoint after that means you accept the new terms.
12. Governing law
These terms are governed by the laws of the Federal Republic of Nigeria. We will try to resolve any dispute informally first; if we cannot, the courts of Lagos State, Nigeria have jurisdiction.
